New Delhi, Jan 26 (PTI) The Delhi High Court has turned down a plea by Anil Ambani Group firm, Reliance Big Entertainment, seeking stay on the release of John Abraham starrer Hindi movie "Aashayein", directed by Nagesh Kukunoor. Reliance Big Entertainment (RBE) had approached the court alleging the film's co-producers -- Percept Ltd and Super Cassette Industries -- had misrepresented facts and indulged in fraud, besides changing storyline from the previously agreed upon script while signing the distribution agreement."I hold that the plaintiff (RBE) is not entitled for an interim order restraining the defendants to release the film," a single-member bench of Justice Manmohan Singh said while disposing of the plea of the Anil Ambani-led ADAG group firm.
The court said that the damage could be "compensated for sufficiently in money" and that it was a fit case, where "balance between the parties is to be maintained", and directed the Percept Ltd and Super Cassette Industries (SCI) to deposit money within a week. "Both the defendants (Percept and SCI) shall deposit 30 per cent of total amount paid by the plaintiff in equal proportion (15 per cent each) before this court... Subject to this condition, defendants shall be at liberty to release the film," the bench observed. The court also directed Percept and SCI to submit an account showing all dealings between them and their distributors and "an account to furnish all the money realised by the exhibition of the film before April 20, 2009".
